I wonder how they will police the dark nets with this and if it will result in people playing ISP hopscotch ie get up to 3 strikes and switch to another isp or if it's 3 strikes never any more internet then get 2 strikes and switch. Assuming the strikes don't follow you theoretically you could do that forever.
I guess people will just start running more complex versions of p2p with tor or some other annoymising system in addition to encryption and ban lists like peer guardian that are the standard these days.

Good luck with policing that. I'd like to see them packet sniff an encrypted system running through a proxy. It could be going anywhere.
